Decree No. 33/2011/ND-CP of May 16, 2011, amending and supplementing a number of articles of the Government’s Decree No. 34/2010/ND-CP of April 2, 2010, on sanctioning of administrative violations in road traffic

THE GOVERNMENT

Pursuant to the December 25, 2001 Law on Organization of the Government;

Pursuant to the November 13, 2008 Law on Road Traffic;

Pursuant to the July 2, 2002 Ordinance on Handling of Administrative Violations and the April 2, 2008 Ordinance Amending and Supplementing a Number of Articles of the Ordinance on Handling of Administrative Violations (below collectively referred to as the Ordinance on Handling of Administrative Violations);

At the proposal of the Minister of Transport,

DECREES:

Article 1. To amend and supplement a number of articles of the Government’s Decree No. 34/2010/ND-CP of April 2, 2010, on sanctioning of administrative violations in road traffic, as follows: 1. To amend and supplement Points a and b, Clause 2 of Article 19 as follows:

a/ Driving a car without sufficient driving lamps, number plate lamps, stop lamp, signal lamps, windshield wipers, rear view mirrors, emergency exit tools, fire extinguishers, steam pressure meter or  speedometer or having such devices which do not work or meet prescribed design standards (if such devices are required under regulations) or having additionally fit tail lights.

b/ Driving a car without a horn.”

2.  To supplement the following Point d to Clause 4 of Article 19: “d/ Driving a car having or using a horn of excessive sound volume according to regulations.”

3. To amend and supplement Point d, Clause 3 of Article 36 as follows:

 “d/ Carrying goods of sizes exceeding the dimension limits of bridges and roads without circulation permits or goods of sizes exceeding the dimension limits of bridges or roads indicated in circulation permits.”

4. To amend and supplement Clauses 3 and 4 of Article 57 as follows: “3. Drivers committing violations specified at Point a, Clause 8, Article 24 of this Decree, in case of driving vehicles with semi-trailers without driver licenses of category FC, shall be sanctioned from July 1, 2011. 4. Drivers committing violations specified at Point g, Clause 1, Article 8, and Point h, Clause 2, Article 10 of this Decree, in case of installing danger signs against regulations, shall be sanctioned from July 1, 2013.” 5. To supplement the following Clause 7 to Article 57: “7. Drivers committing violations specified at Point a, Clause 6, Article 26, and Point d, Clause 3, Article 27 of this Decree, shall be sanctioned from July 1, 2013.”..........
